What is Unwritten Easement?

An Unwritten Easement means unwritten permission by default when some people use your property for a long time and you don't stop them.

Some people (eg hikers) cut across your lot to reach a river without your permission.
If the hikers do that for a long enough time, you (owner) may lose the right to stop them from cutting across your property. ( This means Unwritten Easement or Permission.)

Your right to deny access are prescribed. Hence, it is called Prescriptive Right.

What can you do? Put up interrupting fence, trespassing signs or may be dogs.

ok i didn't read any of that , but…what about the guy in the okanogan right now who is blocking access to these nude tanners who have been tanning naked on his land for years? to my understanding he has been able to enforce his private property rights..

what the hell!? the first word is private!! this is totally inappropriate. It's lewd, lascivious, salacious, outrageous!

true story when i woke up saturday morning and looked down into my yard there was a westfalia parked in my yard..

pop top up and two kids with their bikes biking around.. i looked some more and there was dada taking a leak in my potato patch/garden…i walked down and was like hey bud whats happening? despite appearances this isn't a camp ground.. they were really nice actually and shoved off pretty quick. but still i was like what the fuk ? pissing in my yard is reserved for me and people i know..

possibly contributed to my feeling on private property…

i am from south sask and we obey private property signs..

In all seriousness though, in BC I think it takes 20 years to be granted an unwritten easement, so maybe the guy in Whistler is exercising his prescribed right by putting up the private property signs and such. Sounds like the guy in the Okanagan may be fucked, as the NP article refers to people doing it for decades…

Also, setting up camp in someone's yard? WTF?

in regards to those nudies , just because they have been breaking the law and getting away with it for years makes it right?! this is crazy ! anarchy will break out!!!

but yea the campers in my yard was a bit odd. they had gotten in on last ferry and were heading up coast still..just pulled over and crashed out. how they found my place i don't know..

I'm just lucky they didn't try and claim some free man squatters rights or exercise some first nations claim or find something of archaeological significance….or claim it in the name of some ufo god or something..

I'm not fully apprised of the laws, but I think if there are trails in use for a long enough period of time, the public gains "right of way" access to use them, regardless of who owns the land or pays the property taxes…
