The DNV and their insurers are misunderstanding the implications of the Ontario case, which hinges on the setting. In a "family park", there were legal obligations which were not met, whereas on a reasonably marked recreational trail, users (as per the Occupiers Liability Acts which are almost identical in Ontario and BC) are deemed to have willingly assumed all risks.
