As I recall the law was rewritten to allow the Trans Canada Trail as it crossed private and leased land and the occupiers wouldn't allow the trail unless they were released from the liability.

wasn't even thinking about that, just found it interesting that it still says the trails are illegal but they are now paying to upgrade them.

Agreed! Just providing one reason why the District may want to keep the trails illegal, so that we are all trespassers.

Actually I am well aware of the Act, however, the act appears to protect owners and occupiers, but does it provide any protection for paid builders, unpaid builders (under permit) or illegal builders (no permit)?
Also the Act appears to imply that the owner/occupier is protected only if the rider is considered to be a trespasser. So how would that work on an authorized trail?
I believe that common sense should prevail and that people need to accept responsibility for their own action, blah, blah blah, but that does not seem to stop the outrageous law suits ….
