…indeed it is similar to the apple/samsung contentions - none of the patents should ever have been granted due to prior art in the area from which everybody was borrowing

My money is on Weagle for this one.
I've read both patents and there is a diagram or two that makes Trek look pretty bad.
If the details of the NDAs are true and the dates of filing patents are correct, Trek is in deep $hiznit.

Didn't Trek and Split Pivot make an agreement some time ago to let the conflicting patents be and each just carry on doing their thing? Split Pivot has it's thing going on, and the Devinci bikes seem to be growing in popularity. Trek's got their thing going on, and doing well. So why turn it into a mess, I guess the lure of retroactive royalties are great.
One would have thought that with prior art existing, neither patent should have been granted. If both patents are nullified by prior art, surely neither of them have a legal footing for action. (Written by someone with minimal knowledge of patent law).
I sure am interested to see how this one sorts out though.

As someone with, undoubtedly, even less knowledge then you… I could never figure out how Horst-Leitner/Specialized took a 4-bar linkage suspension system that has been used in cars since the late 19th century, turned the wheel 90-degrees and then managed to get a patent for it?

It seems to me that Patent Law is pretty f***ed and the company with the most cash on hand (see Specialized vs. Scott Bicycles: we know your patent is not applicable in this case but our budget to prove it was $1-million dollars and that didn't cover the discovery so we'll change our bikes now thanks) wins.
DW is apparently a smart guy, so knowing that why would he take on a Trek or a Giant (two of the worlds largest bicycle manufacturer's with oodles of greenbacks and huge, on retainer, legal teams) when they hold competing, but apparently legitimate, patents and can just bury him in discovery (see Specialized vs. Scott Bicycles)?
Sounds like a good way to burn all the licensing money he is getting from DW Link and Split Pivot customers (who, as you point out, are selling quite a few bikes).

I listened to this last night. It's about software patents but it's really good.
Perhaps the huge tech company that just buys patents and sue's everyone if backing DW. That would make things really interesting because they likely have more cash and resources than Trek.
I have the patent on the hardtail. I'ma be suing almost everybody.
